Consignment Sale Guidelines

There have been many questions about the impact on consigning of the new Consumer Protection laws enacted in 2009. In regards to lead and phthalates, their website states that resellers are NOT required to test items for lead but cannot knowingly resell items that do not meet legal standards. As before, it’s important for you to ensure that you do not consign any recalled items or items that are unsafe for children. As a Reseller of children’s toys or clothes, you retain the ownership of all items you consign and thus are responsible for ensuring that none of those items are recalled. You can view a list of recalled items including cribs, play yards, strollers, high chairs, toys with magnets or choking hazards at http://www.cpsc.gov/en/Recalls/ . Since the list of recalled items is very long, we recommend using the Search feature to check individual items.

Below are some general categories of items that you should not consign:

  • No books published before 1985, unless collectibles (not intended for children)
  • No soft vinyl or plastic bath toys or books, feeding items (such as cups or bottles) or other items made for young children to put in their mouth (due to potential phthalates in these materials)
  • No clothing with drawstrings attached around the neck or embellishments that could present a choking hazard
  • No car seats older than 5 years. Date can be found on car seat sticker.
  • No crib mattresses without the open flame standard (16 CFR Part 1633).
  • No stuffed animals with small parts that are a choking hazard to children under age 3.

For more information, refer to the Consumer Protection Safety Commission website directly at www.cpsc.gov or the CPSC Conignment Store information at http://www.cpsc.gov/en/Business--Manufacturing/Business-Education/ResaleThrift-Stores-Information-Center/
